  A recently-released and heavily redacted copy of a Sept. 12, 2012, Defense Intelligence Agency memo to Secretary of State Hillary Clinton, Secretary of Defense Leon Panetta, the White House National Security Council and the Joint Chiefs of Staff said "the attack was planned 10 or more days prior on approximately 01 September 2012. The intention was to attack the consulate and to kill as many Americans as possible to seek revenge for U.S. killing of Aboyahiye ((ALALIBY)) in Pakistan and in memorial of the 11 September 2001 attacks on the World Trade Center buildings."
According to the memo, the attack "was planned and executed by the Brigades of the Captive Omar Abdul Rahman (BCOAR). BCOAR is also responsible for past attacks on the Red Cross in Benghazi and the attack on the British Ambassador, they have approximately 120 members." Rahman is serving a life sentence in a federal prison for his role in the 1993 bombing of the World Trade Center which killed six people in New York.
The leader of al-Qaeda in Libya and alleged mastermind of the attack on the US consulate and CIA Annex in Benghazi on September 11, 2012, Abd al-Baset Azzouz, was arrested in Turkey on November 13, 2014 by Turkish National Police in the city of Yalova, acting on intelligence supplied by the Central Intelligence Agency (CIA) and Turkey's National Intelligence Directorate (MİT). On November 24, 2014, Azzouz was deported to Jordan before being transferred to the United States, where it is believed he is currently being held.
Azzouz was born in Libya, immigrated to Manchester, England in 1994, but left Britain in 2009 for Pakistan, where he became a close lieutenant of al Qaeda leader Ayman al-Zawahiri, before being sent to Libya to run al-Qaeda's operations there.
It is important to note, that Azzouz's al Qaeda operational headquarters was the al Tawhid (or al Tawheed) College in Derna, Libya, a city long known as a haven for radical Islamists. Azzouz's "college" had been authorized by Libyan Under Secretary of the Ministry of Education Fathi Akkari, who was, at the time of the Benghazi attack, one of the eight candidates for the post of prime minister and a hard core member of the Muslim Brotherhood.

“Cheryl told me the Libyans confirmed his death. Should we announce tonight or wait until morning?” Clinton says in the email, time stamped 11:38 p.m. on Sept. 11, 2012.
The email had as its subject line: “Chris Smith.” The murdered ambassador was Chris Stevens.
The Secretary of State didn’t even know the name of the U.S. ambassador to Libya — even after terrorists stormed an American compound and killed him.
Sean Smith, an information management officer with the United States Foreign Service, was also killed during the attack in Benghazi. They’ll no doubt say she meant him — but she actually got BOTH names of the dead wrong.

An explosive new report suggests that former Secretary of State Hillary Clinton or her team may have instructed tech companies involved with managing and storing her emails to delete some records after she was told to turn them over to the State Department, which needed to comply with documents requests made by the Select Committee on Benghazi. One tech employee was suspicious that Clinton's team “really is covering up some shaddy (sic) (expletive).”
The new revelations are in addition to the FBI expanding its investigation to include a second data company, and serve as further evidence that Clinton’s unprecedented and exclusive use of a private, unsecure computer server and personal email account for official government business meant classified information related to foreign affairs and America’s national security was routinely exposed.
The U.S. Department of State Foreign Affairs Manual defines “classified information spillage” as “When classified data is processed or received on an information system with a lower level of classification.”
The Department of Homeland Security Sensitive Systems Handbook states that “Examples include e-mailing a classified document from an account authorized to process up to SECRET to another account only authorized to process unclassified material, or saving a SECRET document onto a thumb drive or CD on a secure workstation and uploading it to a sensitive but unclassified (SBU) workstation.”
Despite her denials, it has been well-established that there was lots of classified information in Clinton’s email:

• There was information that was later classified before being released by the State Department.
• There were emails that “contained classified information when they were generated,” according to the Inspectors General of the Intelligence Community and the State Department.
• There were emails that contained “Top Secret” information when they were received, according to the Central Intelligence Agency and the National Geospatial-Intelligence Agency.
• There were emails that contained “information shared in confidence by foreign government officials,” which “must be classified from the start, and handled through secure, government-controlled channels,” according to U.S. government regulations.

This classified information was not just located on a secret server in the Clintons’ private New York home, which Hillary Clinton had touted as secure because it was “property guarded by the Secret Service.” It has been digitally spilled around the Internet and physically moved to locations around the country:

• Stacks and stacks of boxes on a truck, which is how Clinton delivered all of the emails she chose to print and turn over to the State Department.
• The D.C. office of David Kendall, Clinton’s lawyer, where he kept a thumb drive with copies of her emails outside of a safe before one was installed. The thumb drive was eventually taken by the FBI.
• “A third party data center” in New Jersey, where the Clintons’ home server was warehoused in 2013. The server was eventually taken by the FBI.
• A Colorado-based company, Platte River Networks, which took over management of Clinton’s private email network in 2013.
• A Connecticut-based company, Datto Inc., which stored backups of Clinton’s emails on a “cloud” storage system and is now cooperating with the FBI’s investigation.
• The Clinton Foundation, where staff received classified information in emails from Clinton’s chief of staff, Cheryl Mills.
• Computers at the State Department, which the FBI seized several weeks ago.
• Servers at commercial email providers like Google and AOL, which were conduits for Clinton emails containing classified information.
• The personal email account of Sidney Blumenthal, who was hacked by Guccifer in 2013. Blumenthal did not have a security clearance and he was barred from working in the Obama administration by President Obama’s first chief of staff, but that didn’t stop Clinton from paying him as an unofficial, secret advisor on the side.

Where will the classified information spilled by Hillary Clinton turn up next?
The Associated Press reports that “Clinton's private email server … was the subject of attempted cyberattacks originating in China, South Korea and Germany after she left office in early 2013. … While the attempts were apparently blocked by a ‘threat monitoring’ product that Clinton's employees connected to her network in October 2013, there was a period of more than three months from June to October 2013 when that protection had not been installed[.]”
A separate report last week detailed how “Russia-linked hackers tried at least five times to pry into Hillary Rodham Clinton's private email account while she was secretary of state[.]”
And now The Washington Post reports that “A technology subcontractor that has worked on Hillary Rodham Clinton’s e-mail setup expressed concerns over the summer that the system was inadequately protected and vulnerable to hackers, a company official said Wednesday.

Tom Fitton, President of the conservative watchdog organization Judicial Watch, who said that while he couldn’t speak to the charges of perjury:

Last week, the Hillary Clinton server soap opera continued after the discovery of a string of previously undisclosed emails.

The emails included an exchange between Clinton and General David Petraeus, then-head of CENTCOM, in January and February of 2009.

This wouldn’t be particularly compelling, given the more dramatic turns this story has taken, if Clinton hadn’t signed an affidavit on August 10, swearing “under penalty of perjury” that she had turned over all government related emails.

According to the Associated Press:

“The Petraeus emails, first discovered by the Defense Department and then passed to the State Department’s inspector general challenge…Clinton’s claim that she has handed over the entirety of her work emails from the account.”

Appearing on Fox News’ “The Kelly File,” Judge Andrew Napolitano predicted Clinton’s defense, saying:

“She’s going to argue–because she stated…that she’s not a technical person, and she didn’t pay attention to emails, and she doesn’t understand exactly how the entire email system works–I’m afraid that’s not an argument that the judge wants to hear, and will essentially fall on deaf ears.”

Speaking to potential legal action, Napolitano added:

“I think that the FBI will recommend to the Justice Department that she be indicted.”

IJ spoke to Tom Fitton, President of the conservative watchdog organization Judicial Watch, who said that while he couldn’t speak to the charges of perjury:

“There’s no doubt [Clinton’s] statement was not accurate.”

At some point, it will be up to the judge to decide if Clinton perjured herself, or if her alleged lack of knowledge precludes her from such a charge.

Government finds new emails Clinton did not hand over

The U.S. Defense Department has found an email chain that Hillary Clinton did not give to the State Department, the State Department said on Friday, despite her saying she had provided all work emails from her time as secretary of state.

The correspondence with General David Petraeus, who was commander of U.S. Central Command at the time, started shortly before she entered office and continued during her first days as the top U.S. diplomat in January and February of 2009.

The Defense Department provided the emails to the State Department in "the last several days," State Department spokesman John Kirby said in a statement.

The exchange of 10 or so emails, the existence of which were first reported by the Associated Press on Friday, largely dealt with personnel issues, according to the State Department.

Clinton's use of a private email account connected to a server in her home instead of a government-issued email address came to light in March.

News of the previously undisclosed email thread only adds to a steady stream of revelations about the emails in the past six months, which have forced Clinton to revise her account of the setup which she first gave in March.

Nearly a third of all Democrats and 58 percent of all voters think Clinton is lying about her handling of her emails, according to a Fox News poll released this week.

The email arrangement has drawn criticism from political opponents who accused the Democratic presidential front-runner of sidestepping transparency and record-keeping laws and of potentially exposing classified information to hackers.

The controversy has cut into Clinton's lead in the race for the Democratic nomination for the November 2016 election.

Jamal Ware, spokesman for the House Select Committee on Benghazi, which wants all Clinton emails concerning the 2012 attack that killed four Americans in Benghazi, Libya, said the committee would not have a detailed comment until it had received and reviewed the emails.

"If indeed this is a sign the stonewalling and political protection effort that was previously being run by the (State) Department is diminishing, the committee welcomes it," he said. "The proof will be in the production."

Clinton apologized this month for her email setup, saying it was unwise. But as recently as Sunday, she told CBS when asked about her emails that she provided "all of them."

Last December, she provided what she said were copies of all 30,000 or so work emails she had in her possession, nearly two years after she stepped down as secretary of state.

She did not hand over another 30,000 emails from the period that she deemed personal and said she chose "not to keep."

The emails with Petraeus also appear to contradict the claim by Clinton's campaign that she used a private BlackBerry email account for her first two months at the department before setting up her clintonemail.com account in March 2009. This was the reason her campaign gave for not handing over any emails from those two months to the State Department.

The Petraeus exchange shows she started using the clintonemail.com account by January 2009, according to the State Department.

Clinton's spokesmen, who did not respond to questions, have acknowledged that other work emails from later in her tenure were also missing from the record Clinton handed over. They have declined to say why.

The Federal Bureau of Investigation is now examining Clinton's server as it looks into the possible mishandling of classified information between Clinton and her staff.

Media outlets, including the Associated Press, and several other groups have filed dozens of lawsuits under freedom of information laws seeking Clinton's email records.

FBI Said to Have Recovered Personal E-Mails From Hillary Clinton Server

 

The Federal Bureau of Investigation (FBI) has successfully recovered personal and work emails from Hillary Clinton’s private email server, according to a new report.

Sources told Bloomberg News that some of Clinton’s emails have been extracted from the server, thus disproving the claim that Clinton managed to wipe her server clean after she deleted all of her emails earlier this year.
Therefore, some of the emails that Clinton deleted — the ones that she determined were NOT relevant to federal investigations — are now in the hands of the FBI.
The federal investigation, therefore, is now out of Clinton’s control.
Breitbart News has extensively reported that Clinton’s server, which was managed by a handful of companies including Denver-based Platte River Networks before it was turned over to the FBI in August, might have contained data relevant to the investigation.

The FBI has recovered personal and work-related e-mails from the private computer server used by Hillary Clinton during her time as secretary of state, according to a person familiar with the investigation.
The Federal Bureau of Investigation’s success at salvaging personal e-mails that Clinton said had been deleted raises the possibility that the Democratic presidential candidate’s correspondence eventually could become public. The disclosure of such e-mails would likely fan the controversy over Clinton’s use of a private e-mail system for official business.
The FBI is investigating how and why classified information ended up on Clinton’s server. The probe probably will take at least several more months, according to the person, who described the matter on condition of anonymity because the investigation is continuing and deals with sensitive information.

A review by Clinton and her aides determined that about half of the 60,000 e-mails she exchanged during her four-year tenure as secretary of state were of a personal nature, the presidential candidate has said.
Those e-mails, she said, mostly dealt with planning for Chelsea’s wedding, yoga routines and condolence messages.
Clinton said the personal e-mails were deleted from the server and her staff turned over paper copies of the remaining work-related e-mails in December to the State Department for processing and archiving. The FBI obtained Clinton’s server from the Colorado-based company managing it.

Recover E-Mails

Outside computer specialists have said the FBI has the technical capability to recover deleted e-mails. The exact number of personal e-mails recovered by the FBI could not be learned.
Once the e-mails have been extracted, a group of agents has been separating personal correspondence and passing along work-related messages to agents leading the investigation, the person said.
Since the existence of the e-mail system became public in March, Clinton has seen her standing in polls slide, particularly in regards to questions about her trustworthiness. She also has been heavily criticized by congressional Republicans who have raised questions over whether the private server jeopardized the security of sensitive data.
Internal government watchdogs have determined that classified information ended up on the system. Their findings sparked the FBI inquiry.
Clinton’s attorney, David Kendall, did not respond to phone calls or e-mails seeking comment. Nick Merrill, a spokesman, said, “We’ve cooperated to date and will continue to do so, including answering any questions about this that anyone including the public may have.”

Iowa Caucuses

The bureau’s probe is expected to last at least several more months, according to the person. That timeline would push any final determination closer to the Democratic presidential primary calendar, which kicks off Feb. 1 with the Iowa caucuses.
A bureau spokeswoman, Carol Cratty, declined to discuss any aspect of the investigation. Emily Pierce, a spokeswoman for the Justice Department, also declined to comment.
Clinton is not accused of any wrongdoing. She has said she is confident that material in her e-mails wasn’t marked as classified when it was sent and received through her server. For anyone who mishandled such information, prosecutors must prove that they knowingly did so to charge them with a crime.
The former secretary of state has said she decided to use a private e-mail address -- hrod17@clintonemail.com -- to conduct all of her electronic correspondence as a matter of convenience, to avoid the need to carry two devices, one personal and one professional. She served from 2009 through 2013 as the nation’s top diplomat.

E-Mails Posted

As the result of public information lawsuits, the State Department has posted almost 8,000 of those work-related e-mails on its website. The State Department has determined that dozens of the e-mails contained classified information.
Many of the work-related e-mails contain schedules, press clippings, staffing updates, speech notes, and requests to aides for tech support. Some e-mails are simply requests to speak with people over secure phone lines.
In 2013, the Clintons turned the private server over to a Colorado-based technology company to manage. The firm, Platte River Networks, installed the device in a New Jersey data center and managed and maintained it.
Andy Boian, a spokesman for the Platte River, said the FBI last month asked the company to hand over the server. Platte River asked the Clintons what it should do, and within 24 hours a representative for the Clintons told the company to provide the device to agents, Boian said.
There has been some question as to whether Clinton deleted her messages or took the more thorough and technical step of “wiping” the server. Boian said Tuesday that Platte River had “no knowledge of it being wiped.”
Clinton’s use of a private e-mail system is being examined by congressional committees that have the power to subpoena the FBI to obtain the messages. The e-mails also may be sought under public-information laws.
The FBI isn’t likely to hand over any such messages until its investigation has been completed. Even then, public records laws provide exceptions protecting personal information.

 Judicial Watch Files Lawsuit for Clinton Email Metadata

(Washington, DC) – Judicial Watch announced it filed a lawsuit seeking access to two of former Secretary of State Hillary Clinton’s emails in their original, native format (Judicial Watch v. U.S. Department of State (No. 1:15-cv-01414)).  The native format contains metadata, which provides details such as server information and hidden email recipients.
In May 2015, the State Department posted to its website several emails alleged returned by Clinton to the State Department late last year.  In July, Judicial Watch submitted a Freedom of Information Act (FOIA) request asking for email “as it was sent” for two of the emails – one by Clinton aide Huma Abedin on Sunday, August 21, 2011, from her AbedinH@state.gov email address, and the other email “as it was received” by Jacob Sullivan on Saturday, July 7, 2012, at his sullivanjj@state.gov email address.  Alternatively, if the State Department could not produce the emails in their native format, Judicial Watch requested that the agency produce records that would identify the information contained in the email headers.
The State Department did not respond to Judicial Watch’s FOIA request, even though it acknowledged receiving it on July 9.
Judicial Watch’s lawsuit requests that the court order the State Department to produce the two emails promptly.
A separate Judicial Watch lawsuit forced the State Department to demand that Clinton’s then-top State Department aides, Cheryl Mills and Huma Abedin, return all copies, both electronic and paper, of government records in their position.  Notably, the State Department had not demanded the same of Mrs. Clinton, even though federal law also prohibits her from keeping government records.
There remains a question of whether Mrs. Clinton used a hrod17@clintonemail.com email address to conduct official State Department business.  Although Mrs. Clinton claims that that email address was not created until 2013, the paper copy of the email sent to Jacob Sullivan on July 7, 2012 that was returned by Mrs. Clinton to the State Department shows the “from” email address as hrod17@clintonemail.com.  The requested native copy or its metadata will definitely answer from what email address the email was sent.

Judge Jeanine said there are multiple crimes Clinton could be charged with, including keeping classified information on an unauthorized server, destruction of evidence, obstruction of justice and violating the Federal Records Act.
"There's at least seven that I found," Judge Jeanine said. "The woman should be indicted."
"Was this a mass criminal conspiracy?" Judge Jeanine wondered. "You've got co-conspirators, you've got people taking 'top secret' off of emails, you've got everything a grand jury should be investigating right now."
Judge Jeanine said that America doesn't trust Clinton anymore, and it's likely that her political career will not survive this scandal.
